Unless stated to the contrary on this website, the goods and services supplied in accordance with any contract made though this website are supplied by FWS Carter & Sons trading as Greendale Farm Shop.

Access to this website is granted strictly in accordance with these Terms and Conditions.  These Terms and conditions apply also to all orders/delivery requests placed by you through this website or in store. Please read these Terms and Conditions carefully and print and keep a copy of them for your reference.

We may change our Terms and conditions at any time, so please do not assume that the same terms will apply to future orders/delivery requests. We reserve the right to:

  • Modify or withdraw, temporarily or permanently, this website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the website; or
  • Change the Terms and Conditions from time to time.

You will be deemed to have accepted such changes if you continue to use this website (or any part of it) or you continue to place orders / delivery requests after any such changes. It is your responsibility to check regularly to determine whether the Terms and Conditions have been changed. If you do not agree to any change of the Terms and Conditions, then you must immediately stop using this website.

FWS Carter & Sons has taken every care in the preparation of the content of this website. However, except to the extent
required by applicable law or as otherwise set out in these Terms and Conditions, FWS Carter & Sons does not represent or warrant the accuracy or reliability of any of the information or content about any products or services, software or advertisements (together, the "Materials") contained on, distributed through, or linked, downloaded or accessed from this website.

To the fullest extent permitted by applicable laws, FWS Carter & Sons hereby excludes liability for any claims, losses, demands, or damages of any kind whatsoever with respect to the website or the Materials including, without limitation, direct, indirect, incidental, or consequential losses, or damages, whether arising from loss of profits, loss of revenue, loss of data, loss of use or otherwise and whether or not the possibility of such loss has been notified to Waitrose. The foregoing will apply whether such claims, loss or damages arise in tort, contract, negligence, under statute or otherwise.

Nothing in these Terms and Conditions limits FWS Carter & Sons liability for fraud or death or personal injury resulting from our negligence.  However, if you are a consumer your statutory rights are not affected.

Certain links in this website will lead to websites which are not under the control of FWS Carter & Sons. When any of these links are activated you will leave FWS Carter & Sons website and FWS Carter & Sons has no control over and will not accept responsibility, or liability, for any material or service contained on any website which is not under the control of FWS Carter & Sons nor does the existence of such links represent any endorsement or other acceptance of responsibility or liability by FWS Carter & Sons for any products or services provided or available on such sites. Our linking policy is detailed in Section 4 of these Terms and Conditions.

Except to the extent required by applicable law or as otherwise set out in these Terms and Conditions, FWS Carter & Sons makes no representations, or warranties, in respect of any endeavour by it to review the content of websites to which it provides links or anywhere else in the Service, or any of the Materials and accordingly FWS Carter & Sons accepts no responsibility whatsoever for the accuracy, copyright compliance, legality or decency of any information, material or other content contained in websites listed on the Service or in any Materials nor warrants nor endorses any advertising of third parties carried on the Service nor through the provision
of links to that carried on other websites.

All information or content transmitted by any functionality made available on this website (including any mobile applications or a version of the website optimised for use on mobile devices), including online invitations, e-cards, email or send to a friend functionality are the responsibility of you, the sender.  You confirm that by using this service you will not transmit any material which could be considered offensive, obscene or otherwise objectionable.  FWS Carter & Sons can be held liable either directly or indirectly for the content of any such functionality,
nor for any loss nor damage of any kind which you may incur as the result of your use of this service.  You hereby agree to indemnify FWS Carter & Sons and each member of the corporate group of companies for any such loss which may have occurred.

If any provision of these disclaimers and exclusions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or mis-described products. For further information about your statutory rights contact your local authority, Trading Standards Department or Citizens Advice Bureau.

Customers will be required to register to use the services available from this website. FWS Carter & Sons may decline a registration request at its sole discretion. By registering for the services, customers agree to these Terms and Conditions and agree that:

  • The personal information that you are required to provide when you register as a customer is true, accurate, current and complete in all respects.
  • You will notify us immediately of any changes to the personal information by updating your details on the 'My Details' page on the website or by contacting our Customer Care Team.
  • You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

To comply with licensing and other legislation some services on this website are only available to those aged 18 years and over.

The technical steps required to create the contract between you and us are as follows:

  • You place the order for your products on this website by pressing the complete checkout button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on this website.
  • We will send to you an order acknowledgement email detailing the products you have ordered.
  • Order acceptance and the formation of the contract between you and us will take place on the dispatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it in accordance with the instructions below.

Non-acceptance of an order may be a result of one of the following:

  • The product(s) you ordered is not available from stock.
  • We are unable to obtain authorisation for your payment.
  • A price or product description error is identified.  
  • You do not meet the eligibility to order criteria set out in the main Terms and Conditions.

The contract or any order will be concluded in English. If you do require any information regarding orders you have placed with FWS Carter & Sons please write to the FWS Carter & Sons Customer Care Team, the address details of which are set out above.

Delivery is available in restricted areas. Collection for orders placed via greendale.com is available from the Greendale stores. 

We reserve the right to restrict deliveries in certain areas. This includes the right to withdraw our services to individual customers' addresses if you are repeatedly unavailable to take delivery of your shopping or in other exceptional circumstances.

We reserve the right to limit both delivery and collection dates, particularly during busy periods such as Christmas.

At the point at which you place your order, the full list of available delivery/collection dates will be shown. 

Where a specific delivery date has been agreed, and where this delivery date cannot be met, you will be notified and given the opportunity to agree a new delivery date or receive a full refund. We
shall use reasonable endeavours to meet any date agreed for delivery but shall not be liable for any losses, costs, damages or expenses incurred by the you or any third party arising directly or indirectly out of any failure to meet any
estimated delivery date.

Delivery of the Goods shall be made to your address specified in the order and the you shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.

Risk in the Goods shall pass to you upon delivery of the Goods, or where you fail to take delivery at the agreed time, at the time delivery was attempted.

Title in the Goods shall not pass to you until payment of the price has been made in full. 

We will provide an option for you to collect your order placed via Greendale.com from our farm shop at the following address: Sidmouth Road, Nr. Farringdon, Exeter, EX5 2JU.

If no one is available at your address to take delivery, we may follow the instructions you have given us of where to leave the goods in the circumstances. If we leave the goods on your doorstep or with a neighbour, and they are stolen or damaged, we do not accept any liability, and may offer you a refund or other compensation at our complete discretion.

If, in the unfortunate situation no one is
available to accept your delivery or no suitable delivery instructions have
been provided, a card will be left by our courier asking you to contact them at
the earliest convenience to arrange an alternative delivery time. Redelivery is
subject to availability. A redelivery fee may be applicable. If you fail to
rearrange delivery, your order will be cancelled.

If you have not contacted us to rearrange a failed delivery
or collection within 24 hours, your order will be cancelled and the cost of
your order (excluding the cost of perishable items and any other associated charges) will be refunded to you.

When you place an order with us, we make up the parcel the day before your requested delivery date and send it by overnight courier. Frozen items are placed next to ice packs inside a sealed insulated envelope, then packaged in a thick-walled cardboard delivery box with any other items ordered. We do our utmost to ensure that frozen items are still frozen on delivery, but unfortunately we can’t guarantee it. Still-frozen seafood can be placed straight into the freezer on arrival, but if it has defrosted, please refrigerate and use within two days.

Pursuant to the Licensing Act 2003 it is an offence for any person under the age of 18 to buy, or attempt to buy, intoxicating liquor, or for any person over the age of 18 to buy intoxicating liquor on behalf of any person under the age of 18, subject to a maximum fine on conviction of £1,000. We are committed to upholding both our legal and social obligations as a retailer of intoxicating liquor. In order to achieve this, we have introduced a number of control checks throughout the purchase and physical distribution process. In accepting these Terms and Conditions you agree to provide Greendale.com truthful and accurate information and act in accordance with the Licensing Act of 2003.

Under consumer laws in the United Kingdom, we must supply our goods to you as described, fit for purpose and they must be of satisfactory quality. If we supply services to you, then we must supply them with reasonable care and skill.

During the expected lifespan of the non-perishable product your legal rights under consumer laws in the United Kingdom entitle you to the following:

- up to 30 days: if you have changed your mind about the product you have purchased then unless the product is faulty, you have 30 days to return it in its original condition e.g. kept in the original packaging and labels and is undamaged and unused.

Customers must inform the retailer that they wish to cancel within 14 days of receiving the goods. Customers then have 14 days to return the goods once the retailer has been informed. Refunds will be given within 14 days of receiving the goods back.  

If you wish to exercise your legal rights to reject products you must return them in person to us or post them back to us. 

There may be some exceptions to these rights such as for those products and services listed below where, for reasons of hygiene, safety or under law we are not able to refund or exchange items unless faulty, not as described, not fit for purpose or of satisfactory quality: Chilled and frozen perishable products; gift cards and vouchers.

None of the above affects your statutory
rights. You have additional rights of cancellation if you order products online. These are described below.

Please note that you are entitled to cancel this contract if you so wish, provided that you exercise your right 72 hours before your delivery date. Notice of such cancellation must be given in writing to our customer service team, details as provided above. If you decide to cancel, we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply. This includes the cost of delivery. We will make the reimbursement no later than 14 days after we receive your notification. 

If you are unsatisfied with an item please contact the customer service team in writing. Where a claim of defect or damage is made, the Goods may have to be returned within the best before date or use by date on the product. You shall be entitled to a replacement or a full refund (including
delivery costs) if the Goods are in fact defective and/or need to be returned. Goods returned must clearly show the order number obtained from us on the package.

Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or mis-described products. For further information about your statutory rights contact your local authority, Trading Standards Department or Citizens Advice Bureau. Images are provided to help recognise products. Due to packaging redesign and improvements these may not reflect exactly the pack you receive.

Any of the following cards may be used to pay for your shopping: Visa Debit (Delta), Maestro UK, MasterCard, Visa Credit and Solo. If payment details have been given, we will charge your card at point of purchase.

All customers collecting shopping from our Farm shop, will be asked to provide a copy of the order confirmation email along with the payment card used.

You are entitled to cancel a payment, or have such sums re-credited to your payment card where fraudulent use of your payment card has been made by another person not acting on your behalf.

To allow payments to be taken automatically for your orders we work with our third party provider (Shopify) to store your card details securely. 

We understand your concerns with security and your peace of mind and safety are of the utmost importance to us. As a result, we have developed a highly secure online ordering facility for the Greendale.com. This is specifically intended to give you confidence when you use your credit or debit card to shop with us and when you tell us your personal details like your address or phone number.

Our online food shopping service uses Secure Sockets Layer (SSL) technology to encrypt your details as they are being transmitted to us. This prevents anyone from eavesdropping on your shopping session and keeps your card and personal details private. We allow you the option to store your card details with us via Sage Pay Tokens, so that you can order from us again without needing to type your details in. We only ever show you the last four digits of your card number on our public internet site and of course, this information is 'for your eyes only'. If you do not wish to store your card details with us, you can enter these each time you place an order with the Greendale.com. Your payment details are held in a secure encrypted server which is not accessible from the Internet.

Once your order is processed, the payment details associated with your order are removed from our files.

If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you. We will attempt to deliver a substitute item if an item you have selected is unavailable, If the substitute item is more expensive than your selected item we only charge you the price of your selected item. If you would prefer not to receive substitutions in the future, simply opt-out during the checkout.Please note: refunds will not be issued for substitute items.

FWS Carter & Sons may decline to fulfil any order or we may limit the number of units of products per customer or order (including for any bulk purchases of items on promotion or special offers).
This applies to all orders and also applies to any order where a customer has applied a discount code which they were not the intended recipient of.

Customers who wish to make amendments to their order must contact our customer service team via telephone (01395 232836) or email (customer@greendale.com) 72 hours before  the delivery or collection date.

Some items that are available in store will not be available online. Other items may be excluded at various times.

Please note that whilst we take every care to ensure the product information displayed on our website is correct, product recipes are regularly changed and this may affect nutrition and allergen information; therefore you should always check product labels and not rely solely on the information presented here. FWS Carter & Sons are required to provide Country of Origin information for loose and pre-packed fruit and vegetable produce. For items sold online with more than one possible Country of Origin, all possible countries will be displayed. Please note that in exceptional circumstances, the
actual Country of Origin might vary from the list displayed online. Customers having ordered these items via the greendale.com website will be able to check the actual Country of Origin on the items, once the products have been received. Please contact the customer service team for any queries.

Promotions on greendale.com apply to full price items only, and excludes already discounted items. These promotions are valid when shopping
online or by phone and cannot be used in conjunction with any other offer and
cannot be applied retrospectively. Free postage promotions are only valid for
UK standard delivery to mainland addresses. Discounts are not valid for the purchase of Gift Cards, online or in store. FWS Carter & Sons reserves the
right to suspend, change or cancel any promotion at any time. FWS Carter &
Sons may update these terms from time to time and reserves the right to add
additional terms and conditions for specific promotions during the period of
validity. Any refund you may be entitled to will be calculated according to the
terms of the promotional discount use. Promotional codes are provided and

Weekday Offers: These promotions are valid from 4pm in the Greendale Restaurant only. They cannot be used in conjunction with any other offer or gift card and cannot be applied retrospectively. The discounts and promotions are not valid for grocery purchases either online or in store.
Greendale Farm Shop reserves the right to suspend, change or cancel any

Greendale Farm Shop may update these terms from time to time and reserves the right to add additional terms and conditions for specific promotions during the period of validity. All tickets, for events taking place at the Greendale Farm Shop, are sold subject to these Terms and Conditions (for events hosted by third-party companies please visit the organisers website for terms and conditions). Purchase and/or use of a ticket/s to enter the Event constitute acceptance of these Terms and Conditions on your behalf and on behalf of any person for whom you are purchasing tickets. Greendale Farm Shop reserves the right to vary these Terms and Conditions from time to time without notice and at our sole discretion. Updates will be published on our website www.greendale.com. In the instance of a breach of any of the Terms and Conditions, Greendale Farm Shop reserves the right to cancel the ticket/s and eject the offender/s and retain all monies paid. For the events held on the 5th and 10th July, only persons aged 18 or over will be permitted to enter. You may be asked to provide proof of age by showing an identification document (“ID”) acceptable to Greendale Farm Shop (Valid Photo Driving Licence, Valid
Provisional Photo Driving Licence, Valid Passport). Only customers holding a
valid ticket will be admitted to the Event. You must retain your ticket on you
at all times during the Event. If you are using a mobile ticket, it is your
responsibility to ensure you have a sufficiently powered mobile device enabling you to show your ticket for the entire duration of the Event. Tickets are
not exchangeable, refundable or transferable. Ticket price and availability may be subject to change without notice prior to purchase. Upon purchase, please check tickets carefully as mistakes cannot always be rectified after purchase. Should you realise you have made a mistake during the purchase process, please contact Greendale Farm Shop as soon as you realise so that we may try to assist
you. In the event of a cancellation or postponement you will be entitled
to a refund. Personal arrangements including travel, subsistence and
accommodation in relation to the Event which have been arranged by you are made at your own risk and neither the authorised ticket agent nor the Promoter will have any liability for any such loss of enjoyment or wasted expenditure in the case of a cancellation, postponement or otherwise. You agree that Greendale Farm Shop, its servants or agents will not be liable to you for any
loss, injury or damage to any person (including you) or property however caused (including by Greendale Farm Shop or its servants or agents) in any
circumstances unless due to the negligence or wilful or malicious act of
Greendale Farm Shop, its servants or agents. You agree that Greendale Farm
Shop shall not be liable to you for any indirect or consequential costs,
claims, actual or alleged losses howsoever arising out of or in connection with the Event and/or our obligations under these Terms and Conditions including, but not limited to, loss of profits, anticipated profits, savings, business or opportunity, or loss of publicity or loss of reputation, or opportunity to enhance reputation, or loss of contract or other economic or consequential loss arising from the performance (or any failure to perform) these Terms and Conditions. Greendale Farm Shop will not have any liability to you whatsoever for loss or expenses incurred in connection with the Event or any cancellation of the Event, including, without limitation, costs of any personal travel, accommodation (including camping facilities) or hospitality arrangements made relating to the Event or the cancellation of the Event.
